Welcome to StayPing ("Platform", "we", "our", "us").
By accessing or using our website, application, or services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Platform.
1. Nature of the Platform
StayPing is a communication facilitation platform designed to help guesthouse owners communicate efficiently with their guests.
We:
- Do not own, operate, or manage any guesthouse
- Do not act as an agent, broker, or guarantor
- Do not verify guests or bookings independently
All hospitality services are provided solely by guesthouse owners.
2. Eligibility
To use the Platform:
- You must be at least 18 years old
- You must be legally capable of entering into a binding agreement
- You must provide accurate and truthful information
3. Guesthouse Owner Responsibilities
By using StayPing, guesthouse owners confirm that:
- They voluntarily provide their own contact details
- They are authorized to represent the guesthouse listed
- They add guest phone numbers lawfully and with valid consent
- Guest data is added only for legitimate stay-related communication
- They comply with all applicable laws, including:
- IT Act, 2000
- Digital Personal Data Protection Act, 2023
- Telecom and messaging regulations
StayPing is not responsible for how owners collect guest information outside the Platform.
4. Guest Information & Consent
- Guest details are added by guesthouse owners, not by StayPing
- Guests are not required to create an account
- Owners confirm they have obtained necessary consent from guests to:
- Share contact details
- Send transactional messages related to the stay
Any misuse of guest data is the sole responsibility of the guesthouse owner.
5. Communication & Messaging
- The Platform enables communication via WhatsApp, SMS, or similar channels
- Messages must be transactional and service-related
- Promotional, spam, or unsolicited marketing messages are strictly prohibited
- Message delivery depends on third-party providers and cannot be guaranteed
StayPing does not control message content created by users.
6. Prohibited Use
You agree not to:
- Upload false, misleading, or unauthorized data
- Use the Platform for spam, harassment, or illegal activities
- Send promotional messages without consent
- Attempt to bypass platform security or safeguards
- Misuse messaging APIs or third-party services
Violation may result in immediate suspension or termination.
7. Payments & Subscriptions (If Applicable)
- Fees, if any, are displayed before purchase
- All payments are non-refundable unless stated otherwise
- StayPing reserves the right to change pricing with prior notice
- Taxes are applicable as per Indian law
8. Data & Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how personal data is handled.
By using StayPing, you agree to the collection and processing of data as described therein.
9. Third-Party Services
The Platform may rely on third-party services such as:
- Messaging providers
- Cloud hosting
- Analytics tools
StayPing is not responsible for outages, delays, or failures caused by third parties.
10. Limitation of Liability
To the maximum extent permitted by law:
StayPing shall not be liable for:
- Booking disputes
- Guest behavior
- Property-related issues
- Message delivery failures
- Financial or reputational losses
11. Indemnification
You agree to indemnify and hold harmless StayPing from any claims, losses, or damages arising from:
- Your misuse of the Platform
- Violation of laws or regulations
- Unauthorized use of guest data
- Content or messages sent by you
12. Suspension & Termination
We reserve the right to:
- Suspend or terminate access without notice
- Remove content or data violating these Terms
- Cooperate with law enforcement if required
Termination does not remove your legal obligations.
13. Modifications to Terms
We may update these Terms at any time.
Continued use of the Platform constitutes acceptance of the revised Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of India.
Courts located in India shall have exclusive jurisdiction.
